By accessing or using Dokly ("Service," "Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Dokly provides a documentation platform that allows you to create, publish, and manage documentation websites. Our Service includes:
- MDX editor for creating documentation
- Custom branding and domain support
- Interactive API playground
- Search functionality
- Analytics and insights
- Hosting and deployment services
3. Account Registration
3.1 Account Creation
To use certain features of the Service, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your account credentials
- Accept all risks of unauthorized access to your account
- Notify us immediately of any unauthorized use
3.2 Account Eligibility
You must be at least 13 years old to use this Service. By agreeing to these Terms, you represent that you are at least 13 years of age and have the legal capacity to enter into this agreement.
4. Acceptable Use
4.1 Permitted Use
You may use the Service for lawful purposes only. You agree to use the Service in accordance with all applicable laws and regulations.
4.2 Prohibited Activities
You agree not to:
- Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable

- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the Service or servers connected to the Service
- Use the Service to transmit viruses, malware, or other malicious code
- Engage in any automated use of the system without permission
- Attempt to reverse engineer, decompile, or disassemble the Service
- Use the Service to spam, phish, or distribute unsolicited content
- Resell or redistribute the Service without authorization
- Impersonate any person or entity
5. User Content

You retain all rights to the content you create, upload, or publish through the Service ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service.
5.2 Content Responsibility
You are solely responsible for your User Content. You represent and warrant that:
- You own or have the necessary rights to your User Content
- Your User Content does not violate any third-party rights
- Your User Content complies with these Terms and applicable laws
5.3 Content Removal
We reserve the right to remove or disable access to any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.
6. Subscription and Payment
6.1 Pricing Plans
Dokly offers both free and paid subscription plans. The features and limitations of each plan are described on our pricing page.
6.2 Payment Terms
For paid subscriptions:
- All fees are in U.S. Dollars and are non-refundable except as required by law
- You agree to pay all fees associated with your chosen subscription plan
- Payment is processed through our third-party payment processor (Stripe)
- Subscriptions automatically renew unless cancelled before the renewal date
- We reserve the right to change our pricing with 30 days' notice
- You are responsible for all applicable taxes
6.3 Cancellation and Refunds
You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. We do not provide refunds for partial months of service or unused content.
7. Intellectual Property
7.1 Our Property
The Service and its original content, features, and functionality are owned by Dokly and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
7.2 Trademarks
"Dokly" and our logos are trademarks of Dokly. You may not use these trademarks without our prior written permission.
8. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
9. Service Availability and Modifications
9.1 Service Availability
We strive to provide reliable service but do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We reserve the right to:
- Modify or discontinue the Service at any time
- Perform scheduled maintenance
- Implement updates and changes
9.2 Service Level Agreement
For paid plans, we target 99.9% uptime. Details of our SLA and any credits for downtime are available upon request.
10. Third-Party Services
The Service may contain links to third-party websites or services that are not owned or controlled by Dokly. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services.
11. Disclaimers and Limitation of Liability
11.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
11.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOKLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
12. Indemnification
You agree to indemnify, defend, and hold harmless Dokly and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
13. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.
14.2 Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court to protect its intellectual property rights.
15. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after the effective date of any changes constitutes acceptance of the new Terms.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely matches the intent of the original provision.
17. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Dokly regarding the Service and supersede all prior agreements and understandings.
